Your Statutory Rights
By law, you have the right to withdraw from your purchase of an item, except items embroidered with an academy, college or school’s logo (“bespoke item”), or non-returnable Bespoke Items (“non-returnable item”) within 14 calendar days of the item’s delivery to you. To exercise your right of cancellation, you must give us written notice by hand, post or email, giving details of the goods ordered and (where appropriate) their delivery, please head this notice “order cancellation”. Notification by phone is not sufficient. Please note this policy does have some limitations.
Please note that you will be responsible for the cost and safety of returning the goods to us unless we delivered the item to you in error. The goods must be returned to the following address: Scallywagz, 63 High Street, Daventry, Northamptonshire, NN11 4BQ and they must be in saleable as-new condition. You must take care to ensure the goods are not damaged in the meantime or in transit. For your protection, we recommend that you use an insured recorded-delivery service.
As soon as we receive notice of your cancellation of the order and its safe return, we will refund the relevant part of the purchase price for that item within 14 days.
Terms and Conditions of Sale
The following terms and conditions apply to all transactions on www.scallywagz.co.uk. The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. These terms and conditions do not affect your statutory rights. To order goods through this website, you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
IT IS ONLY WHEN: WE HAVE NOTIFIED YOU THAT YOUR ORDER MAY BE COLLECTED OR HAS BEEN DISPATCHED; OR WHEN WE HAVE ORDERED ITEMS IN SPECIFICALLY FOR YOU, THAT WE HAVE A BINDING CONTRACT.
We have the right to refuse, at our discretion, to supply any goods ordered by you.
Description of Goods/Warranty and Liability
Although we warrant that the Goods will at the time of delivery correspond to the description given by us, the majority of products we sell are manufactured in large quantities and it is not practical to publish the exact deviations in sizing of all the products. All images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods. Full details are available from the original manufacturer’s brochures & websites. Except where the Customer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977, section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or conditions of the goods whether implied by Statute, Common Law or otherwise are excluded and the Customer warrants that the Customer is satisfied as to the Suitability of the Goods for the Customer’s purpose. Goods are not sold on a trial basis.
If you buy goods which have no published specifications, it is your responsibility to establish the suitability of the goods for your intended purpose.
In the event that a product is listed at an incorrect price due to a typographical error or error in pricing from our suppliers, we shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.
On the order, you must provide us with your exact address and telephone number that your credit card issuer has on file for you. This is for your security as a cardholder as much as for ours. If the information held by your issuer is incorrect or out-of-date, it is your responsibility to update this information. We accept no liability for delays or order cancellation due to this.
Availability of Goods
All products are subject to availability and may be withdrawn at any time. In the event of supply difficulties, we reserve the right to substitute a suitable alternative product of equal quality and value. Manufacturer labels may vary from those shown. However, it is our policy to contact you if a product is out of stock and if you do not wish to proceed with the order, you must let us know within 24 hours of being contacted. After this period has passed, the missing items will be ordered in specifically for you and the usual returns policy will apply. If for any reason, we cannot supply the product we may arrange for the order to be cancelled.
We offer an extended range of products that are not held in stock and must be ordered directly from our supplier. It is our policy to contact you to explain the delivery situation with these products. You might be able to cancel your order for a non-stock item in accordance with our returns policy.
Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
Delivery of the Goods shall be made to the Customer’s address and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
Where an incorrect address has been given to Scallywagz.co.uk with an order, we reserve the right to charge for any extra carriage costs incurred.
Note: If you ordered several items to be delivered, we may send them to you in separate packages to give you the fastest service.
Our couriers may require a signature upon delivery. If you choose to have your delivery delivered to a neighbour, we cannot be held responsible for any potential losses, we therefore recommend receiving the delivery yourself.
IT IS STANDARD PRACTISE TO CHECK THE CONTENTS FOR PHYSICAL DAMAGE IMMEDIATELY AFTER YOU SIGN FOR THEM AND BY ACCEPTING OUR TERMS AND CONDITIONS YOU AGREE TO ONE OF THE FOLLOWING:
1) If the goods are obviously damaged before you sign for them (for example, there is a large gash in the parcel), you will sign for them as “damaged goods” or you will reject the delivery entirely. In this instance, please contact us as soon as possible so we can provide assistance.
2) If there is no obvious damage upon deliver but while inspecting the contents you discover something damaged, please contact us immediately so that we can help.
Time limitations for notification of delivery problems
Damaged in Transit
Should there be any damage to the delivered goods, it will be your responsibility to inform us immediately, but no later than 3 working days. It is imperative that you take pictures as evidence of the damage and do not dispose of any of the packaging, as this will be required to affect your claim against the carrier. We will make a claim against the carrier and reimburse you for the cost of return of the damaged goods and will authorise replacements to be sent to you.
It is your responsibility to sign for the correct number of packages as shown on the delivery or carries consignment note. If you suspect that there are items missing from the delivery, first check that the order has not been part shipped. Any shortages must be made known to us within 3 working days of delivery.
It is your responsibility to notify us of any incorrect goods supplied within 2 calendar days of delivery. If the items are not what you ordered, you must not open the manufacturers packaging or use the item.
Cancellation of Orders (Returns Policy)
If you wish to cancel your order of a non-bespoke or non-personalised item and return it for a full refund, you have up to a total of 14 calendar days to contact us after the final receipt of your order.
You must inform us in writing (email is sufficient) if you wish to cancel your order.
You must return the goods within 14 days of notifying us of the cancellation. We will reimburse you within 14 days of receipt of the goods using the same means of payment as you used when placing the order.
You are liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods. For example, if it goes beyond the sort of handling that might be reasonably allowed in a shop. We will deduct this amount from the value of the refund.
If a return or cancellation would result in an order’s value falling below the threshold for free shipping, Scallywagz reserves the right to deduct the cost of our cheapest shipping method at the time the order was placed, from the refund.
We regret that we cannot accept cancellations of bespoke or personalised items as well as gum shields, open packages of socks or tights or other such personal items. You may exchange bespoke items, except non-stock items or sale items, for the same item but in a different size within 14 days of receipt in an unused saleable condition. You may be liable to pay for any damage or loss of value due to misuse. This timescale is reduced to 7 days for orders placed between 1st July – 5th September.
If you think that the product you have purchased is faulty, we will replace the product for you.
A restocking fee of up to 25% is charged on returns which prove to be non-defective.
If for any reason you are issued with a refund, please note the following:
All refunds will be issued to the same payment method as on the original order. A refund will usually reach your credit card account within 4 working days, please allow up to 10 working days for it to be credited. If the goods are found not to be faulty or they have been damaged by misuse, they may be returned to you and no refund will be issued.
Except as may be implied by law and except in the case of death or personal injury where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by us the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages.
We will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond our control.
Our failure to insist upon the strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.
In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
These Terms and Conditions shall be construed in accordance with English Law.
